Car insurance claim procedure
My uncle tells me that he was involved in a car park accident where he was hit in the rear whilst he was reversing out of a bay. Both drivers are senior drivers. My uncle has no insurance just ctp. The other has insurance. They switched details and a few days after the accident my uncle receives a letter from the other party's insurance company asking if he admits responsibility or wishes to discuss. Ofcourse, believing he was right, he wrote back choosing to discuss to which he has received no further communication. He then took it upon himself to go the other party's insurance company's office in the city where his details were taken but he has heard nothing since.
I've never been involved in an accident in Australia so I'm looking for advice here as to what my uncle should do.

how long ago was this? Your uncle shouls get in contact with other partys insurance to see how the claim is progressing providing hes found to not be at fault. They often take weeks as your uncle is not their customer they will be in no hurry, he will have to chase them. It would also be a good idea for him to get some insurance for himself...

Was a police crash form lodged in the correct timeframe?
I'm sure there is an insurance ombudsman to speak to too. No insurance ftl.

were both drivers reversing out of the bay's and both didn't see each other?
If this is the case, most insurance companies deem this to be 'each at fault', and they will both cover their respective members car. In this case, your uncle will pay his own damages because he is not insured, whilst the other guys insurance should pay his damages. I'm pretty sure that is how my gf's insurance company views it. |

Thanks Jase. My fiance has just moved in to motor insurance from home insurance, so she is studying up at the moment on the PDS and policy rules etc... and I'm sure she was talking to me about this the other day!

Your uncle doesn't have to do anything at all. Both reversing, both at fault. Both pay excess if they want to claim or have insurance. If the other insurance company contacts you then worry about it, but I doubt you'll hear from them unless the other party tells a different story.

If they lodge a claim against you. You can dispute it, it will then be initially dealt in house with their Internal Dispute Department, if there is no resolution then your dispute will be forward to FOS, Financial Ombudsman Service.
