Scenario: my fiancee's younger sister last year replicated a photograph of mine on canvas for a TEE Art project. She ended up winning a prize, but before collecting the prize money, she had to get explicit written permission from myself as the original creator of the 'expression'. I had to also sign off on the fact that I would have no claim to any of the prize money, or money gained from the sale of the canvas. The photo in question: Not trying to start any arguments, just posting in regards to my experience as above, and also as a graphic design teacher. I'd hate to see Jimmy S get taken for a ride if he ever output some of his artwork in a large/mass run.

In regards to any possible issues with "derivative copyright", from all the research I have done and everything I have managed to read, there is no clear line in regards to what I do, and very little to try and work out what is and isn't included as a "derivative" of the original photograph. From what I can understand, as there is no portion of the original photograph in my work, it cant be claimed as a derivative of the original photo. Its all very complex, but from everything I have read, there is no issue with my work and how I do it. According to some sources, if I was to modify a photograph using photoshop(which I DONT do as I start with a blank white screen and dont copy or paste any parts of any photograph into it), I would take on "joint copyright" on the resulting image, with me owning any altered parts of it and the photographer owning any un-altered parts. Regardless of all of that, any work that I do for a profit is done from photo's I take personally or are given to my by the owner. If anyone is interested in reading up on the whole thing, check out this LINK

Always best for artists to err on the side of caution in regards to permissions, be very transparent in what you're doing, blah blah blah. ps. awesome work Jimmy. They keep getting better

Wouldn't the easiest way be to credit where the original work or inspiration for work came from?
It would be the same as writing a technical paper, you can't just write things down and claim it all as your knowledge, you reference accordingly.
