Anybody know what Section 62 is?

Looks like to coppers want to try me on for violating Section 62 of the RTA for my little incident I had a few weeks back.

Does anybody know what Section 62 of the RTA is or how I can find out?

Cheers

62. Careless driving

Every person who drives a motor vehicle without due care and attention commits an offence.

Penalty: 12 PU.

Giddyup 24-08-2005 11:49 PM

1 x PU (penalty unit) is $50. You do the math.

jEstEr? 25-08-2005 01:23 AM

creepin 25-08-2005 03:54 AM

If ya only receive a ticket in the post, then the prescribed infringement penalty is only $100 with 4 points. If ya get a summons then the penalty is up to the court obviously, but as a rule of thumb they dish out the equivalent of infringement penalties or thereabouts, unless the offence elements are at the high end of the scale.

wombat 25-08-2005 08:33 AM

4 points! shit.

wombat 25-08-2005 08:39 AM

so is this just a standard fine for anyone that has a single car accident? do they consider weather conditions etc? and how long before the fine is usually sent after the accident?

When I was on my P's I was charged with Careless Driving....I lost my lisence.

I'm pretty sure the new rules dictate that if you're on your P's, and you receive a Carless, Reckless or Dangerous driving charge (obviously), you automatically loose your lisence regardless of how many points you may have left.

I know your not a P Plater but this is how I got stung. So if your a P plater just be very careful how you drive. You can receive a careless driving charge for the dumbest of things... For instance in my case, it was a 90km/h zone, and I could prove that I wasn't exceeding the speed limit, however because it was wet I was apparently going too fast for the conditions....(60km/h)....I was charged. What pissed me off though is how do determine how fast is too fast in conditions like these? It seems that no matter what you do, either way your going to get nailed.

Quote from the officer at the scene on the night: "We dont call situations like these accidents anymore. They're called crashes....and they happen for a reason. So we have to charge you with something...."

/rant off

Giddyup 25-08-2005 11:19 AM

What was the incident in question?? You may be able to ask for a lower infringement perhaps....

I had an incident over a year ago now. A Motorcyclist slammed into me. Long story short i was told i "failed the right of way" even though he was indicating to turn before the intersection.

14 months on i still haven't heard a thing from the cops in regards to penalties etc. Now, with one month to go on my P's and only one point left.... i'd rather not get a note in the mail saying "by the way, we're cancelling your license... come back three months for another two years of P Platerage... luv u long tiem!!!!"

In all likelyhood, Dan, wombat, i'd dare say unless you caused injury or harm to another person they're unlikely to come down on your too harshly....

Though after talking about my own incident for the first time in 12 months... i'll get home to a letter telling me they'll see me in court!

*grumble* murphys law *grumble*

wombat 25-08-2005 12:00 PM

i would ring them up to try and find out but i dont want to tempt fate...

Yep really bad!

P.s it was 3 points and $100 and no I am not contesting it, I am copping it on the chin. I farked up on the police report, thats why I got done with dangerous. I ticked the box which said I was out of control. ahh well, I will learn from my mistakes.

DAN682 28-08-2005 11:18 AM

The letter I got goes a little like this:

All traffic accidents, whethere attended by police or self reported by drivers involved, which comes within the bounds of the road traffic act, are investigated by the police services crash investigation section, to establish whether a breach of las has occured.

the police inquiry is not intended to establish the civil liability of any driver involed in a traffic crash, as the evidence required to successfully prosecute is significantly different to that required in any insurance claim or civil proceeding which may arise of this incident.

The collision you were involved in came within these bounds and it was determined that an offence was committed.

Based on the information provided in the file, the enclosed infringement notice is issued.

Then there is the fine neatly attached to the back of the document.

wombat 29-08-2005 10:10 AM

bollocks, argh! :(
