Doesn't it actually have to be proven that Swann unfairly damaged Essendon's reputation out of malice by saying stuff he thought was untrue? Essendon's reputation was destroyed by the charge sheet. Swann's comments haven't changed anything or damaged their reputation any further than what the public already think.

Also, its interesting to find out the particulars of the case, because who did Swann "defame"? Companies (large corporations like the EFC) can't be defamed under law. Individuals can only. Who has been defamed?

For the purpose of counting the number of employees, part-time employees are to be counted as an appropriate fraction of a full-time employee.

Anyway, Essendon have been found guilty of cheating before (1993 Salary cap breaches) so technically what he said is true

They won't get a cent out of the Blues, you watch. They are hoping that we just bend over and settle out of court, but Swann will call their bluff, the last thing Essendon would want is for this to go to court.

Plus once the ASADA report is released and players start getting infraction notices, it will all be a moot point anyway.
