Your rights
Anyone care to enlighten me as to my rights in regard to my car and the police ?
Specifically do I have the right to deny them my consent to search the inside of my car or, to examine my engine bay? I found this interesting http://youtube.com/watch?v=uV0g5B1bl...elated&search= But it is quite obviously made for an american audience and no doubt our laws are considerably different. |

I think they have the right to search. I believe they even have the power
to drive it. Some of the local Ecilop will be able to confirm this.

There are many different powers to search for police. In the end, if there is nothing to hide, get it over and done with.
If a copper wants to look under your bonnet, they can.

I think you will find, If an officer can justify to himself doing anything (searching, driving, handcuffing your resistant ass) then he can and will.
And so they should. |

Why do you want to know? apart from the obvious? Let the cops do their jobs and you will be fine. |

Police can search any car that is using public roads for no reason and the *generally* occupants within it.
Its obviously different if its at your house. Basicly if you step foot or drive on public property (namely the roads, foreshore etc.) you loose alot of your rights. But like everything I'm sure there's some situations which create exemptions. |

Police can search your car if they have a reasonable suspicion that you may be hiding something. Also they have the right to look over your car to ensure that it complies with Aust standards (VSR) Check

But it crosses the line when the just dump all the shit on the side of the road and leave Freo cops FTL
That said, if you think your being treated badly (and of course the police never do this..) remember that most phones these days have video and sound recorders which can come in handy when you want to make a complaint! Last edited by Mat; 14-05-2007 at 10:50 PM. |
