Default Search Warrant?

Hi guys, just got pulled over over by the cops tonite bcos in August this year i was spotted by an off duty policeman "driving eratically" on nicholson rd. No ticket just a precaution. Fair enough! The second cop then proceeds to check my car for any faults. Apart from thr BOV,nothing is illegal. While i was getting lectured for my BOV the other cop flashes his light in my vehicle & spots my backpack. He opens the door ands starts going thru my backpack, bags, toolboxes & glovebox. He find nothing and lets me go. My question is, is he allowed to go through my belongings without asking? I don't mind him searching the car but my backpack?

Only if he has reasonable grounds to suspect you are hiding something.

did you give any attitude?

Did he ask you if it were yours?

Did you ask for his badge number??

Did you ask him why he was rumaging through your bag? and under what pre-tense?

Could have been more inconvenient and stickered you for the bov.

If he has reasonable doubt to think you are committing an offence and or you are carrying contraband yes he can.

He still should have asked.

did nothing to piss them off. i was very polite, because i knew they couldve stickerd me. just pissed off that he started searching my stuff. I had nothing to hide. the other cop was advising me that my BOV was illegal & that i should fit better brake pads bcos of the build up of brake dust etc, etc.

Agreed. A smart detective would, because he would have you imply ownership etc.

Had they had found something, they then have to prove it was yours! (Rookies IMO).

I bet the cop puts oil on his brakes to stop them squeking too I've heard of some silly things cops point out but for dirty wheels, c'mon

They usually ask if they can search but the times i have said no, they say that they have good reason to seach. Its fun watching them spend 20min + going all around the car

This is why I always leave a backpack in my car containing a tube of anal lube, a cucumber and some gloves.
