Leaving the scene of an accident

Now, on my journey as of about 15 minutes ago, i went to get bread. Shops ran out (go figure) so i went down the servo. Out of nowhere a dude flips his motobike on a straight piece of road.....Second on the scene followed by a few others. Not much blood as he was wearing full leathers, helmet etc. I helped get the bike up which was pissing with fuel with another bloke and made sure there was an ambulance on the way etc.

Now i spose the question is, legally was i able to leave the scene? I figured someone was attending to him, ambulance was on the way, bike was cleaned up and there was a car with hazards on and another 10 people there. I was just going to be another gawker. Is leaving the scene of an accident only if you are involved in it?

Thanks,

Eric

Would only be an issue if you where involved in or witnessed the accident
and as he was the only one involved theres not much to wittiness

Would also be an issue if you had given him any form of first-aid

haha thanks dudes, it all happened so quick was not sure where i stood. Like i said, last thing that is needed is a crowd of people stareing at the poor bloke.

I don't know where you get this from, probably from watching too much American T.V where they "sue your ass off", you have to remember we live in AUSTRALIA. It is now very hard in Australia to sue someone civilly, there is also safeguards in place to protect what is known as 'Samaritan's' who are attempting to do the right thing, but may inadvertently cause injury/ death. Additional information can be found by searching for public liability restrictions.

Good on you for stopping and helping him. As all have said if you leave the scene of an accident without exchanging details (that is if you are directly involved in e.g you crashed into him) then you are committing a criminal offence.

Though you cannot be charged with anything if you simply sit there and watch the man bleed out on the road, and anything minor they could think of if they did want to charge you with could easily be defeated in court.

Maybe if you dont have any training, this might be true, but you have any medical or first aid training, then you can and most likely would be charged for failing to assist.

However, there is protection in place (to a degree) for anyone assisting however, if you actions are wreckless, no matter how good the intentions, you can sued.

In the end, the most important thing to remember is, if someone at the scene has the training and you dont let them look after the person. DONT BLOODY ARGUE WITH THEM!! (Had this before where someone decided to start an arguement with me on looking after someone who had come off his motorcycle on Albany Hwy. I knew what I was doing, they sure as f*%# didnt.)
