I've read a number of default clauses in loan applications, and the bank have every right to do this if its stated in the documentation. The black and white of it is, that if the bank have to outlay more funds, and take a hit, it will be at the liability to the financee.
Its business and when it comes to finance, defaulting is a take no prisoners affair. If it isnt stated in the documentation, then you obviously have a case. Make sure he has every piece of paper work and correspondence in place, it can be one clause that will make all the difference.
