Car Crash
Hi All
I just want to start by say that this is not my story but a lady at works. So lady at work lends her car to her boy friend. Boy friend smashes into the back of another car. The lady that lent the car had not paid rego and was 8 months overdue. Insurance company fixes both cars. The person that was crashed into has now put in a personal injury claim. Now what I want to know is the car owner liable or the driver of the unregistered vehicle. I told her she should call the DPI or a lawyer. Thanks all |
The driver of the unregistered vehicle. Tell him to Lawyer up.

Not sure about the property insurers, but for the personal injury if he knew it was unregistered, or it's proved that he 'should have known' he's liable. If he didn't, she's liable. As the car was unregistered, ICWA (the govt CTP insurer) will recover the cost of the claim from her (although most who do this cry poor and ICWA recovers $20 a week before writing the hundreds of thousands/millions off after a couple of years)

Step 1: See a lawyer ASAP.
Step 2: Register the car farken. Step 3: Bitch slap both parties for driving unregistered cars on the road. |
Thanks for the info guys I will pass it on to her.
She is sh1tting bricks atm. |
If only there was such a thing as a rego sticker you stuck on your windscreen. He could have been 100% sure of its status before stepping into the car.
|
^^^ good call! Two mates of mine have been fined, partially because DPI have an incorrect address on file (despite being advised) and they never received renewal notices plus they haven't had a sticker there to prompt their memories, and partially coz they're morons

This. If they knew, they would have not paid out the claim. |
