Fuck me some people here have no idea how a deposit works.
On top it seems he was offered a chance to rectify the issue. Guy obviously changed his mind or his daddy pulled the funding, and was using it as an excuse.

If this was fought through, you would be held accountable for duty of care. Sure you may have to spend 10k legally to prove the point, but he does have a leg to stand on, irrelevent of your contract.
