If they are switched to only come on with high beam (as per driving lamps) you would be ok I believe.

I really can't understand the foglight ruling that seems to be rigidly enforced when most other states allow them, and we're encouraged to turn on lights for safety. As long as they don't dazzle oncoming cars (factory fogs are usually well diffused) I can't see any reason why they dont encourage their use. Every day I see countless cyclists without helmets getting away with it, yet the moment you turn the fogs on you get nailed like a criminal.

I use mine late at night when I arrive home so I can turn the headlights off and see the driveway and not wake up my neighbours.
