Speed Checks
 
I dont know if its been said already but being a cop myself you have to know the law....go figure...


Speed check is used when you do not have the necessary equipment in the car to accuratley check the speed of another car (radar etc)

To speed check a car, you nominate a car that you believe is above the posted speed limit and you follow it. As you follow the vehicle in front you must maintain an equal distance between your car and the car in front, so that you're doing the same speed as the vehicle in front. After you have followed the car for a approx 300 metres or more and you and your partner agree that he car in front is speeding can you confidently pull over the driver and issue the driver a infringement.

This way it will stand in court as you have evidence to prove your case

The way the other officer is doing it he has no evidence at all.

That said he officer has been probably driving for years and can tell just by looking at your car from a distance and judge that your car is speeding. Its called experiance. A car in the distance that is weaving in and out of traffic and is making ground on the other cars around him, this stands out like dogs balls and as a police officer this is what we are looking for.

If your travelling at the posted speed limit then you blend in and we dont notice you, if you travel around in a car that stands out then we notice you.


But in the end you require evidence that we stand up in court, not just a hunch or experiance to carry you.

I think as Darlyn said if a car is weaving in and out of traffic, and overtaking cars at a speed obviously faster than the rest of the cars, it is safe to assume they are driving above the legal limit and therefore breaking the law. It would not be likely that all other traffic is sitting 10 - 20kph below the posted limit.

Now, it is one thing to make an educated observation that the vehicle is exceeding the legal limit, but saying you can determine by how much over it actually is with the naked eye using 'experience' is at best a guess and should in no way be able to be used as 'evidence' to book/charge the driver for anything other than maybe dangerous/reckless depending on the extent of weaving/tailgating etc....

I personally have no issue with an officer charging you for reckless if you are cutting people off, weaving continuously through traffic at an obvious higher speed (if you drive like a dick you deserve the penalty), but I draw the line at the officer being allowed to give you a speeding fine where he is 'guessing' a speed.

My opinion only...

Meh who cares..... if speed was the actual cause of crashes I would have been dead long ago... . Driving faster than your cars grip level on a given set of road conditions and weather is highly likely to result in a crash. Driving within the safe limits even if going 2 or 2.5 times the speed limit will not result in a crash. Autobahns are the proof of this.... on a dry clear day you can do 250 no worries......I doubt they do that when its winter and icy.

The problem with Australia is that Driver training, compulsory ABS and Airbags and zero alcohol level limit would be far too costly to put into place. Like any business they choose to do things which generate revenue.

So the cops can all get stuffed. Why don't they go issue infringements to the people involved in more than 3 accidents in the last 5 years as they are the bad drivers its not the "hoons".

PS at least 80% of fatalities in WA are in the country.

Hmmm... Not true. The freeway and tonkin hwy are classic examples of
where people simply don't look at the signs. I have so many times on the
freeway where I have been doing 100 and overtaking everyone, other
days they are all overtaking me.

Anyone who has ever got onto Tonkin hwy at Guildford road heading
south will know that most people never actually get to 100. They
seem to sit around 70-80kph well past the next exit. For some
reason they get agro when I fly past at 100 (the speed limit).

But if you driving 250kph and there are 2 or 3 cars in each lane, blocking you off and travelling 80-100kph, you have to brake quite a bit before you reach them, and if your brakes fail or you were going too fast to brake in time then you'll most likely have a crash. Not always to do with grip level... many other factors can be involved

to say speed doesnt cause crashes is perhaps the dumbest thing i've ever seen written on this forum, your previous posts excluded of course polar. Speed is a huge factor in most crashes and to say otherwise is simply ignorant. Saying all cops are fucked is just stupid and immature, get a life and a clue.
