Default Automatic Problem, MY98

Alright, the car is a 98 wrx with an auto, only mods being a 3 inch TBE and BOV.
Every day, for the first trip only, it wont shift any higher than 2nd.
Sitting in the driveway, it engages reverse perfectly.
Then once backed out it engages 1st perfectly when put in Drive.
Shifts to 2nd no problem either.
Now it wont shift into 3rd and when the revs get to about 3500-4000 in 2nd, it loses drive and just free revs until the revs drop down low again.
after about 4-5 mins of putting along, it'll shift into 3rd and then 4th when it should no problem.
It does it in both Drive and clicking though the gears manually. And only for the first start in the morning. Every other trip during the day is fine. Its not cold here in the morning and ive checked the fluid level, which is good.

Any ideas?

silly question but you haven't got the gear hold button "on" have you?? the little switch next the the shifter with the snow flake symbol on it?

as above, double check the hold button, or reset the ECU.

Nope, dont even think it has one, the old gx did.
And if it was, the snowflake shows up on the dash from memory.
After 5 minutes it rights itself.
Does it in power and economy mode too.

EDIT, just checked, it does have the switch, but it wasnt on.

what colour is the trans fluid bright red? or a brown/orange/black colour? might need a service, or have a sticky valve body? or mayby there is a solonoid fault?

Yeah, the thin film on the dipstick looked pretty pink, nice ATF colour.
Guess i'll just take it down to a workshop.

I had the same issue in my MY98 Auto and it ended up being the fact it had 2 speed sensors and 1 was showing different data to the other.

The fix was to replace the speed sensor

By memory you can check it using one of those really expensive SNAP-ON tools
