Default Wilson Parking Fine Screwup

Hey Guys,

Bit of a story ..

About a month ago i recieved a letter from Parking Enforcement Services stating that I had an overdue parking fine. Had a read through it, and it claimed my vehicle was parked at 'PER 106 Alma St' in Fremantle on 6 Feb 2008 at 12:50pm.

Had a really good think about it, and could not recall ever being parked there. I went through my emails, calendar and IM logs, and sure enough I was sitting at my desk at work in Canningvale with my car parked outside when they claim it was elsewhere!

Anyway, I follow the procedure, lodge an appeal with a cover letter and some supporting evidence proving it was not me. They send me another letter, saying i've still not paid it. I call them up, they say they've recieved the appeal and it may take months to process.

The letter i have recieved states that if i pay the fine within 7 days, as a 'courtesy' to me, it will be $45.00. Otherwise i need to pay $60.00. If i do not pay, my car is on their clamping list. Cunts.

Driving home today, get a call from my workmate, who i told about this whole thing - And he tells me that there was a big parking fine bungle, heaps and heaps of people effected. Some agency somehow got hold of peoples details through the DPI, which is who this Parking Enforcement Agency people are.

So now i have no idea where i stand. I aint paying the fine as it simply wasn't me, and i can prove it, with a stat-dec if required. I'll be happy to take it to court if required, as i have already spent more than that in my time dealing with it.

If they had the balls to try, i'd seriously contemplate a counterclaim for wasted time over $60!!

Anyone else been fucked by this?

Is this a scam?

This bit especially (clipped from the 'post' article)

The onus of proof was on me to refute this fee – and as I have no knowledge of the alleged offence, I of course have no copy of the original fine (September 2/2007)

I thought the onus of proof was upon proving guilt not innocence. The State Government changed this for Multanova fines, but surely a private company would be bound under common law?

I got fined, FES came after me. I appealed. They accepted.

Well that's the thing, I think it's just a dodgy scam. But if it is, it's high up as someone can match my numberplate to my house .. for lots and lots of people.

Someone dodgy working within (or in collusion with some one from) the DPI could get hold of the info. All they need is access to the vehicle registration database, and I'd think just the medium level customer service staff would have access to the info.

Wilson parking fines don't need to be paid anyway. They are not an government agency, so you are not obliged to pay the fine. However, its likely, if you park in one of their carparks again, you will be clamped, but, just avoid doing it.

I got fined in NB one night, $80 i think it was, and i never paid it. Fuck em. However I have changed cars since then, so they couldn't clamp me anyway... as the description doesn't match the vehicle.

I saw the article on the news, Wilson parking approached DPI and asked for ppl's addresses so they could send out parking fine enforcement letters. Completely wrong IMO. A private parking company should not be able to access that information. The only thing they can obtain, is your vehicle make and drivers licence. The rest of the info they shouldn't be allowed to access where you live etc..

Wilson's will also charge you $50 if you loose one of their parking 'tickets' to get your car out. My girl got stuck once, had to pay the $50 for virtually a piece of card.
While i think Perth city only charges $20 for one of those round things which has a magnet in it....

bit of a ripoff imo for $50.
