Default Seat belt removal = Defective?

Okay peoples,

Having a bit of a no brainer with a truck driver at work who has been doing the job for 30 years blah, blah, blah and he seems to think that the fact he has no seat belt for the passenger seat that his truck is fine and not defective.
Now the truck is about 10 years old and came with seatbelts so my thinking as that if it came with it and doesn't have it now he can be yellowed.
I'm the transport planner and couldn't be bothered arguing after about 5 mins so I'm looking for a pdf or similar that I can print out and show him.

If I'm wrong please let me know, otherwise thanks for your help.
