Question bout Insurance Commision (3rd party injury insurance)
 
Has anyone here been involved in a crash and made a claim from the Insurance Commision of WA ?

Did you get a pay out and if so.. how bad were injuries and what sort of payout did you get ?

I have a claim in progress I just have no idea of what (if any) sort of pay out to expect...

any help appreciated

Mate of mine has been waiting for his claim to be 'finalised' for over 4 years now.... He has back and neck injuries that require weekly visits to chiro/physio... Dont' think he's getting much considering the pain and suffering he has/is going through (think around $30k)....

A friend of mine was passenger in a car her ex bf was driving. Accident was his fault, she got $35k or so as the accident ruined her dancing "career" :rolleyes: Injuries were hardly extensive.

Yeah I have a friend with a similar deal. The way I understand it.. they dont finalise the amount until you have made a "complete recovery".. from your injuries. My whiplash etc has all healed and the panick attacks have stopped.. just wondering what to expect.. if anything..

Did your friends use lawyers or jsut fill out the forms and wait for an offer ?

As with all compensation you will not even be considered for payout until you have a clearance form a doctor. ie if you have whiplash from a physio if you consulted one and for Panic attacks a shrink.

And sorry if it's all over by now I wouldn't be expecting too much of a payout as your suffering has been minimal in their eyes.

If you haven't seeked professional advice ie Doctors you have got little to no chance.

To put it in perspective I saw Dr's for 6 years when I lost part of a finger until I got clearance and an official disabiltity rating, then you get the payout. (and it's not much) you want the big bucks and want to increase the burden on vehicle registration (this is where you pay compulsory 3rd party) go and find an ambulance chaser lawyer and they will tell you how too play it up.

lol I like how you are implying im trying to blow things out of proportion to get more money.. :confused:

Of course I went to docs.. event spent the night in hospital etc...

i was just told by someone that I would get a payout and Im trying to confirm if thats likely or not. thankyou so much for your constructive and supportive comments :D

I went through all this a few years back.

I totalled 2 years worth of physio/medication/medical expenses. Do see a lawyer. Whatever the insurance company offers you in compensation - the government gets the first $11500 on all whiplash claims. This was to reduce the number of non-legitimate claims.

Seeing a fairly good lawyer will definitely help out. In my case, I got a fair bit through 'loss of opportunity' in regards to sport which i was doing at a professional level at the time. Medical bills dont really play a part, nor does time off work, unless it amounts to a significant figure.

A lawyer will normally want you to see an independant docter/specialist, as will the insurance company anyways.

See a lawyer, take their advice and go from there.

I agree with Adz, after being involved in an accident when I was 17 it took over 3 years to get compensation.

Depending on your injuries of course.. best advice, get a (good) lawyer because you will get offered the bare minimum to start off with, hoping that you'll accept that and disappear. :)

Takes time unfortunately, just be prepared to stick it out!

Do yourself a favour, if you can forget it........forget it. I wish I had. I have a chunk out of my neck, half a dead r/hand & more, I spent 6 yrs going through hell with a so called "good" lawyer who's bill was well over $100,000 & I've spent the last 2 years with another lawyer trying to get back the over $50,000 he overcharged me. Thank you MR P O'hallo...NOT. If you have a minor psychological problem now it will be MUCH worse in 4 - 6 years.
Just some friendly advice.......take it or leave it.

Sorry Tara just started ranting and couldn't find the off switch.

Believe it or not what I was trying to point out is unless you have a legitimate claim don't bother or be prepared for a VERY long and drawn out process where the only people who win are ambulance chasing lawyers!
