Sounds like you've been fucked around good and proper.

So long as there are no conditions on the deposit (usually a good idea to write the receipt up as a 'Non-Refundable Deposit' for future reference - makes it crystal clear) he hasn't got a leg to stand on.

Some people like to put down "subject to vehicle inspection". That means stuff all to be honest. The vehicle has had an inspection, whether it passed or not is not in that contract terms.

For reference, if you put down a deposit and are unsure it will pass a vehicle inspection, you need to put down "Holding deposit, subject to buyers satisfaction of vehicle inspection by RAC". That would give you more leverage.

However, that is really of use for car dealers. In a private sale to get the deposit back would be near on impossible if the seller doesn't wish to return it.

Leaking righthand CV boot ($50 for a whole 2nd hand shaft)
Gutter rash on rims (no point fixing)
Heater not working (nfi)
Right control arm is damaged (say $100 for 2nd hand)
dent in fuel tank (is this important?)
Front rotors need replacing ($50 for a whole hub assembly...)
Rear Break pad needs replacing ($100)
Cracks rear spoiler ($50 replacement?)

I think it would be more than that.. i put around 1gs to have it all fixed properly..

Smokey: 2000 for deposit, thats the reason why I held it for 2 months for this f*cker I thought he'd go through with the deal with this big deposit
