The new hoon law was introduced to assist the Police in obtaining crediable evidence which could be produced at court.
Its still up to the Police officer to put the matter before court not the old prick who lives next door. The way the law works is a person makes a complaint, police investigate the complaint and if there is enough evidence for a prima facia case (assured of a prosecution) then the officer will put the matter before court. If the officer believes that the evidence put before him might not get a conviction then he will write off the complaint as insuffiecent evidence to prove a successful prosecution. I have plenty of people making silly complaints to me. If the evidence put to the officer shows the car doing burnouts and you can make out the number plate and the driver and the time day and the place where the incident took place then there is enough evidence to prosecute. If the officer is shown a car going around and around and lots of smoke and you can not make out the number plate or even what type of car it is then it gets written off. As with anything if your not doing anything wrong then they cant be video'd doing wrong |

The moral of the story is you will need to putter around casually goign unoticed and then LET IT RIP, HIT 200 and your gone. That way no dickheads can dob you in because you went from doing the speed limit to about 300m in front of them very quickly.

It all seems a little overboard allowing people to gather their own evidence and present a one sided view to the Police. It won't be too easy to obtain successful prosecutions, as you've already flagged the evidence needs to be spot on. There will be some loop holes but people in time will work through these, as for malicious reporting, this to a certain extent is to be expected but hopefully common sense will prevail. If you're going to be stupid infront of people that have a different degree of tolerance expect to be reported.

I want to know at what point will pictures and video become inadmissible in court
due to tampering ? With the quality of CGI and most camera's now being digital, I am sure it would not be very hard to photo-chop a pic of the premiers car with smoke puring off its wheels in kings park. Now will that stand up in court ? How do you prove a digital image has not been altered ? or completely fake ? If you EVER get told they have a pic, NEVER admit anything. Force them to prove it in court. Require proof that the picture has not been altered in any way. Introduce reasonable doubt about the authenticity of the video/image, and that the device it came from is not considered secure and could have been tampered with before it was handed to police.
