Vehicle sale, test drives, licence check & impounding
Hey all,
Quick question - how are we supposed to allow anyone to test drive a vehicle when there is no method to check if their licence is current? You can check if the licence has been suspended for fines, not a impounding for 28 day offence but could lead to insurance issues if they have a bingle on the test drive - http://www.courts.dotag.wa.gov.au/_a...es/search.aspx and the response is immediate. BUT only a individual can check if their licence is suspended due to court order or "hooning" etc here - http://www.transport.wa.gov.au/licen...ence/19984.asp It takes 24 hours though and the test driver could easily "doctor" the email, let alone, that their licence could have been suspended between the inquiry time and the email being produced. This effects anyone selling their car or anyone loaning their car. Just thought I'd put it out there.

Surely if you get a copy of the liccy and they are suspended, it would be fraud or something?

I'm sure it would be Kato BUT that would be a civil matter to regain costs incurred etc.
I brought it up as it is a blatant quandary to have such owner onus laws on vehicles and drivers without a method to "check" the validity of a licence.

I maintain that there's a difference between a test drive and a road test.
Test drive = A thrash to see if a particular type of car is fun to drive. Road test = A procedure to determine if a car has faults only noticable while driving. Don't let anyone test drive your car. If they want to check if there are faults that may make them not buy the car, then take them for a drive yourself. An agreement to purchase the car at a predetermined price should be reached before the drive provided no faults are found. I'm sick of people wanting to drive cars when they don't even have the dosh. |

So from a legal perspective you cant say that 'on the balance of probabilities', or 'but for', the prospective purchaser telling you they had a valid license you would have never let them in the car in the first place?
Tests Applied: - but for/common sense; - balance of probabilities (unsure if this applies for civil cases).
