Default Taking away a pay rise.

Is it legal if you get a promotion and you get a substantial pay rise, that after a month your boss realizes he put your pay up to far and reduces it again? Because that just happened to me this morning and I lost 4k of my pay rise.

Depends if you've done something wrong or not met the requirements for the payrise? If you've done nothing wrong I'd be speaking to DOCEP or whoever for advice.

Went to the docep website. Will have to wait till I get home tonight to dl a few of the PDFs to get a bit more info. But apparently I can lodge a complaint about lost payments on the contract.

if you have it written down on a signed contract then no they can`t without some serious breach done on your behalf to back up there reason
if the contract is signed by both parties and you have a copy of the contract with the signatures and rate off pay clearly spelt out then you have a case i think you will find if you have not breached any performance or failed to achieve any stated benchmarks in the contract

I'll check my contract when I get home. I know that my signature ison it I'll just have to check if my bosses signature is on it.

what if it was an honest mistake by your boss?
if he accidentally gave you a payrise to 500k a year then reduced it down again once he realized the mistake, would that still be unacceptable?

depends I spose on whether your payrise was discussed in detail and agreed upon by both of you before it was put in place. If that's the case and it was then reduced down then yeh, that's pretty low. Not sure if it's illegal but definitely seek professional advice about it.

It can be done - I have done it a few times for various reasons and there are different ways to do it - DOCEP have me on speed dial though as does the ombudsman.

We had a guy in a similar situation. Got a payrise. A few months later the company worked out he got it and we wasnt actually supposed to. They asked him to actually pay back all the extra money he had been paid.

He refused, obviously (his payrise only just meant he was getting paid the same as people who been here 2 weeks compared to his 2years) They ended up *no longer requiring his services*
