If its a big end bearing, any good Subaru mechanic can diagnose it without stripping anything.. and they'll be able to write you a report too.
Jim Hall might be a good idea as you don't have to tow the car. First indicator is metal in the oil.. get a high res photo of the dipstick with the metallic looking oil on it to attach to the report. I'd be putting something in writing too about the cost of that 2nd hand long motor, and getting the dealership to cover the cost if they're willing to help (better than spending 4.5-8.5k as per your previous quotes!) |

Any mechanic worth their salt should be able to identify a big end from listening to it.
Personally, I'd be suprised if you get the car fixed under warranty from the dealer. They have so many outs on this. Try the reverse of what they are asking... getting them to put it in writing that if it is a big end gone they will fix it under warranty. It seems like they are just yanking your chain and when the time comes they will just walk away. Going to court will cost you more than a whole new engine rebuild, so that is just a waste of time and energy.

Edit-- Ill try and get this in writing, then contact the dealership and see what happens. Should they give me the run around, ill probably just get this 2nd hand long motor should it be the big end bearing. Save hassle, and time. Oh well, won't mention the dealership that sold it to me but lets just hope karma is as effective as everyone thinks it is, haha =P |

The implied terms of sale apply in several ways including that the good sold be of a merchantable quality. Although MQ is assessed at the time of purchase, it also has a durability aspect to it meaning that if a serious defect arises or is uncovered some time after the purchase, it may be deemed to have not been of MQ at the time of the purchase and hence fall within the scope of the implied warranty under the Trade Practices Act / Fair Trading Act.
Another implied term that may apply is that of fitness for purpose. A good that is sold for a purpose (car = travel on road) must be fit for that purpose. A car that blows an engine within two months of sale may be deemed unfit for its purpose. There is a case at common law where a guy in the UK drove over 2,000 miles in a period of around 1 month before the engine decided to call it a day - this was covered by the the fitness for purpose implied term. Without more facts, given the nature, age and mileage of the vehicle, and the fact that it occurred a good two months after the purchase, I'd say that your case is somewhat impeded. Regardless of this, it's definitely worth pursuing as the dealer may use their discretion and decide to contribute to the repairs due to a fear of prosecution or as an act of good faith.

Wouldn't be the first time mods have been stripped for sale and a crap tune put in so it would run.
Either way with close to 200k my preferred option would be get one of the good shops to do something properly and have years of worry free use than waste money and time arguing with a dealer who if they do come to the party will do it on the cheep and likely have a similar issue in a year or two. Sux man I know but do you want it done right or do you want to hate your car???
