The used vehicle statutory warranty covers your vehicle for a period of 3 months or 5,000km (provided that the vehicle had < 150,000km at the time of sale). Essentially, the dealer has to repair any defects that are not service related or a consumable, provided that they were not caused by the new owner. What most people don't realise is that it does not matter that the defect did not exist at the time of sale. The dealer is responsible for repairs so long as the defect arises within the 3 months / 5,000kms!

That pisses me off so much mate - get back there and get your money back!! I can quote you section numbers from the Motor Vehicle Dealers Act if you like.

i have the act, out in front of me division 4 section 34 a - e infront of me highlighted at the appropriate positions. preparing for the war dance

Yep, they're the relevant operative provisions.

I'd start off nicely by casually asking why your standard dealer warranty didn't cover the problem. Then slowly start introducing terms like statutory warranty, defect, an obligation to repair a defect under s34 of the Motor Vehicle Dealers Act 1973.

Get onto it as I'm sure someone from the dealership will see this at some point.

The important thing is to stay calm and professional...don't get into stand up arguments...deal with the service manager, not the plebs...listen to reason but stick to your guns. Be prepared to ask to talk to the DP if you're unable to get satisfaction. Remain polite at all times.

no no, i rattled off a few lines of the act. they said they would call me back they spoke to their legal department no doubt.

then the guy calls me back acting like "he had helped me out" by wearing the cost of it.

nonetheless, problem solved.
