It shouldn't require the sim to be activated.

Can you see if u can delete the file that has already made a file for your iPhone 5 so that your computer/iTunes thinks your plugging it in for the first time. Obviously a factory reset before deleting file may be wise.

Backup your old phone, (i think you rightclick the phone name in ituens and it should give you the option), then connect the new phone, right click the name and select Restore from backup. thats what i did when i when i changed iphones many moons ago

If that option isnt there, after you do a full factory restore on the new one, when you plug it in to itunes it should give you the option to restore from a backup (should have the name of your old phone on one plus the date you did it)

Thanks guys I had to go into a fresh computer load up iTunes then my iphone4 backup then upgrade the OS then backed up to my iPhone 5...

Mission but it worked!!
