Default Is it illegal to drive with the fog lamps on?

Hey all

Tonight on the way home I was pulled over for a random breath test and was told by the officer that it is illegal to drive with the fog lights on (apparently it carries a $250 fine and 3 demerit points!)...my question is, how can something factory on a car be illegal???

And how come its illegal in the first place? I switched it back on when I got home and it doesn't look any brighter than the standard xenon lights!
Anyway, shouldn't Subaru warn us about this or remove the lights altogether before handing us the keys?!!!

Finally, is it legal to drive with the fog lights on during the day?

The officer who told me this, also drives a MY09 wrx sedan so maybe he's on this forum and could answer these questions for me?

(apparently) theyre put on for the places that get really foggy...
worthless in perth but oh well..

Yeah they are illegal. I got a $100 fine and 1 point last Saturday night on Ennis Ave (11pm) where there was no lights on. Pitch black and I get pulled.

The reason he told me was they interfere with multinovas when they flash.

This has always been a much talked about subject.
Fog lights are called that for one reason, When there's fog!
Definately illegal to use at any time.
Easy fix, just buy the STi fog covers and remove the switch in the cabin

Yes it's illegal.

And no, it doesn't look cool. Leave them off except for times/areas of poor light. (Fog, torrential downpour etc).

gotta love cops and their failure to understand the laws they are employed to uphold.

The guy you got was probably the same cop that told me:

'there's absolutely nothing wrong with your car, but I'm going to have to give you a Yellow for your BOV'.

Why are BOV's not allowed?

'because it gives people asleep the shits'.

FYI: BOV was Full Atmo, and at that point in time I'ed only had the car for a month or so and was p.oblivious to what laws applied. It was just a fluke that my 'device that gives people the shits whilst asleep', was actually non-compliant.

Flame suit prep'ed and ready for take off.

Only way I remember it is legal on-road is if they are the only main lamps on facing forward and since you cannot legally (or unless you are severely mentally challenged) drive with these lights only at night, it means you can only run them in daylight hours....no fog...no point...disconnect them so your friends with the wicked sense of humour don't hit the switch for you while you're not looking.

Nobody really wants to see a WRX owner running around trying to look like a Falcadore ute owner anyway.

There is some rule about having lights closer than 10cm to the ground

And this should tell you something about the nett value of the foglamps, they only serve to blind the crickets, not Multanovas.

A fog lamp only serves to illuminate a spread area close to the ground in front of the car (below the fog level) and allow you to see through it to a degree rather than bouncing light directly off the mass of water particles in front of you.

In this case there is a better than even chance he is right.

it is also illegal to have your fog lights on with headlights, its either one or the other

I've argued this before, was pulled in bunbury in my wrx and I argued they are not foglights, as true foglights are yellow - which penitrate fog better than white - no luck.. so just don't use them

(incidently I had them on from that morning where I was driving to work, in fog)
