so what did you actually do?? i dont get it??

you just accelerated from the lights but didnt lose traction? WTF is hoon'ish about that (to a reasonable person) ???

if it goes to court no doubt the copper will say you were racing the engine and/or testing the vehicles acceleration.. these fucking gay ass laws leave it way to open to unfair interpretation - i mean are you not allowed to use full throttle anymore??

hoon law is anthing slightly reckless. i was 'hoon lawed' for speeding (i wasnt racing anyone or anything like that). i dont think that been in a hurry makes you a hoon but my opinion doesnt count for much (when up against the law).

you DO NOT receive anything from them at the scene, you'll get a summons in the mail (in a week to a month..). that's if they were serious..

mine took less than a week.

Doesnt sound like they had a gun out....sounds like they were busy.

Did they show you a reading of your speed, then do their usual deduction of 2km/h for calibration purposes?

You would have been charged under any of the smoke, acceleration or speed testing sections of the Traffic act.

Shauno, have a read of the Hoon Legislation listed above for the exact definitions.

If you were not charged for speeding (lack of a gun reading), you did not loose traction, there was no smoke, you were not weaving up the road erratically then a good lawyer will get you off. It is up to them to prove these things happened and it was just not a subjective observation from police while they were busy doing something else.

If you have time slips from Kwinana I would be taking those along as evidence that you drive a WRX that YES does accelerate quickly up to the legal speed limit. You only speed test your car under controlled circumstances and not on Public Roads.

However, if as you have said you admitted to being a dickhead and maybe said a bit too much after being pulled over then that will be used as evidence. Police being friendly and talking about your car is sometimes not what it seems and can be used to gleam further info from you.

SO IN FUTURE EYERYONE:

If pulled over and asked the standard question "What speed do you think you were doing ?"

Answer "Can you please tell me or show me Sir as I was busy looking ahead up the road"

Admit Nothing unless you were trying to avoid an Accident.
Don't say too much, even if the mood is friendly.
Try and remain calm and let the police prove to you what you have done wrong.
Take witness' names and Phone Numbers.
Photos of the scene if possible.

Drink driving, ironically, isnt a hoon law.

Yeah thats right, one of the worst offences around means they dont take your car, so you can go back and kill someone.

Mat, I didnt mean run, but if someone waved a torch at me like Shauno stated, id find it rather easy to mistake any intended message

They have to prove the element of wilful intent, ie you wilfully kicked it in the guts, if they cant, they CAN NOT hoon you.
