I'm in the same situation as jazzy, broke up during building and I have been living in the house and taken care of all costs.

I will be refinancing with my brother to replace her, as soon as the house has the equity to do so.


I gave her back all the money she put down at the start, and bought the furniture she had got for the house off her.

Mitch, I wouldn't be asking for your 1st home buyers back, and as she has looked after the house and associated costs, you may not be entitled to the 50/50 split should it go through court.

Lawyers should be able to help you settle an agreement to sell and cover her costs in the house.

Anyone going through this...

Step 1 - See a lawyer!

Even though you might come to an agreement between yourselves, if it is not written up correctly any party can come back later and ask for more.

Any time substantial money is involved, get a legal eagle to check it out.

This was my advice... and hes set coz Mitch's mrs is a lawyer, not a family or property one but her colleagues are covering him in that department.

Bit of an update on this one.

Took Kato's and JAZZIE's advise and saw a lawyer (My Mrs is a commercial lawyer so wrong juristiction)... but she referred me to somebody else who charged me nothing to help out.

Off to family court this Friday so will fill ya'll in on the outcome of the hearing. Let's just say if I get anything out of this I'll be buying my STI haha!

Now that I'm aware of this threads existance, can any one recommend a good builder for narrow (10m wide) lot homes?

Just been through a few of the builders looking for this... Ross North were best in my books
