That sucks it should be if they dont find defects then there should be no charge. In the case of Yellows anyway - not for exessive noise, that could be because your sitting outside someones house bouncing off the rev limiter at 2am. Thats excessive noise, but it's still not worthy of a defect as long as its not over the legal limit.

Unfortunately the excessive noise thing is similar to dangerous or reckless driving, they may not be able to establish an exact speed in court, but if they think the factors could support a judgement in their favour you get something worse than a speeding fine.
It's a bit like factors of aggravation. Makes you think that it's not always fair, but then justice ain't always balanced. |

Yeh they cant drive around with DB meters out the windows haha, Excessive noise or too loud is up to the police officer issuing the fine/defect notice.

Some shit I got from cops in the past after getting pulled over:
"Is this your car?" (lady and guy cop) "Why did you indicate right?" (this cop already had a bad day before he pulled me over) "You do realise you cut me off.... next time it will cost you 75 bucks" (he was 100 meters away and driving at about 20km/h on a 60 zone when I gave way and turned the corner) "You guys got any drugs in there?" (me and mates in the car talkin about good old times) "You 2 ok in there?" (me and my Ex gf having sex in the car)
