No I haven't. And at no point in my posts have I condoned DD. I acknowledged he broke the law, but he has been treated like some kind of pariah despite blowing over the limit by just 0.009. And I totally agree with you, hoon laws should apply to DD as well. But I don't think we need 0.05 and 0.08 rules. Make it one or the other. Because people know that if they blow between 0.05 and 0.08 they'll only receive a fine they push the envelope. If you lost your license with a 0.05 reading, a lot more drivers would not risk it.

0.009 (0.039 actually) makes it sound insignificant coz we are dealing with very small numbers here, but if you look at as 78% over the limit as stated numerous times you can't argue that he is "just" over.

Exactly

If he had an accident and somebody died. No insurance and jail. Try telling the judge you were just over...

Well this goes back to my previous point about 0.08 being the 'actual' legal limit. The Govt has determined that 0.08 is the point that somebody is incapable of driving a car when intoxicated, NOT 0.05. If they had any evidence that suggested the license suspending limit should be 0.05 then it would be, end of story.

The LEGAL limit is 0.05 before you are deemed to have broken the law and penalties are enforced.. 0.08 is the point at which the penalty is increased to loss of licence

not hard to understand really..
