Well nachjoe blew 0.089....so he is over 0.08 aswell and therefore "incapable of driving a car".

End of story?

In Australia, it is against the law to drink and drive with a BAC over 0.05%

*taken from one of dozens of ACTUAL websites outlining the ACTUAL LEGAL limit in Australia

Thats why I used air quotes. We have 2 different limits - legal (0.05) and ability to drive (0.08). So in regards to this case, legally the guy was way over, if we want to talk ability to drive then he was marginally over. Why do you think the Govt has 2 levels? If they wanted an additional limit to cover for discrepancies then they would make it 0.05 and 0.06. You need to understand the concept of the 0.08 limit. Why do you think they have 2 limits? Like I said before a lot of $$ has been spent on determining 0.08 to be the limit at which a person is not safe to be driving a car NOT 0.05. That is the legal limit.

2 pints and no food: he should have known he would have been over the limit, Not that food would have made much of a difference anyways, because the BAC is how much is in your blood, not your stomach

legal limit - .05%. never heard of this .08%, but even if he was "only just .009%" over, since when would that make it ok?

"im sorry officer, but i only killed that guy once, thats only 1 more than the legal limit"

umm, I could be wrong, but if you had a a BAC of .5 youd be either unconcious or more likely dead?
