I would agree to the use of conditional instead of subject.

ma missus had a holden cruze 03 the mini 4wd types, and now she has started working with wedding dresses, and she drives them around a few times a week and the cruze is too small, wedding dresses get all tangled up inside etc, so she wants something similar an the dualis came the closest, cruze is a GREAT car, specailly economy, but we need sumthing bigger

the deal is the same, but now that we have the money instead of trade in, we are paying full price, when i can get it for less, or even full wack plus extras

might be ok for wedding dress and all but don't get it for kids. with one kid in back and two adults, it sucks ass and also then it will be even slower due to weight. if you are tall it will also suck because your head will touch the roof. drivers side has option of seat lowering, passenger doesn't

Think of it this way - if you rocked up to pick up your car, and the Nissan guy was like "oh yeah some dude offered 1k more than you, so we sold it to him, bad luck"

How pissed would you be?

This is why you sign a binding contact - it sorts the serious from the not.

I managed to walk away from 2 signed contracts to buy cars. I put 2 stipulations on the contract.
Pending buyers finance approval from chosen lender
Subject to satisfactory 3rd party inspection.

The first one i didnt like the car and my bank "pulled" the finance.
2nd one after a inspection, i picked approx 5 things wrong with the car, one of which was why did it have a jap dash, i asked to have the ecu kms compared to dash kms - they didnt want to. I walked away :-)

Isn't there a statutory cooling off period on ALL contracts and sales?? I believe that there is unless that time period has elapsed.

Also any conditions for a house/car should be something like the following; (change to suit car or house)
this contract conditional to the buyers complete satisfaction (completing their due diligence (House)) within XX days of acceptance of this contract and should the buyer not provide written confirmation that they are totally satisfied (with their due diligence (house)) then this contract comes to an end and all deposit monies will be refunded in full.

Never only have subject to finance because the vendor/car yard can arrange finance (called vendor finance) at an outrageous rate and fees etc then you are still locked in. There is no real need to state where the finance is coming from it is more important to have "conditional to finance approval that completley satisifies and is acceptable to the buyer in entirety"
